Rules & Regulations
1.HOW TO PARTICIPATE IN THIS EVENT (The Washington County “Hunt for History”): Register to enter, pay the $40 entry fee (when applicable) and obtain an “Official Clue Sheet/Treasure Map” from Colossus Enterprise LLC at any participating Washington County organization or at www.huntforhistory.com. Contained within the clue sheet are several puzzles that, when solved, will direct you to the location of “Object Clues” for use in the subsequent clue on the clue sheet. The solutions to the clues and puzzles can be redeemed for the prize, which consists of $5,080* in gold or $2,500 in the form of a check from Colossus Enterprise LLC. The first person to locate all object clues and solve all the puzzles using their intellect and skill, who satisfies the eligibility requirements and follows the redemption instructions set forth below, will, upon verification, receive the prize. The potential finder must register and pay the entry fee at the time of obtaining an Official Clue Sheet, with the exception of the finder being under the age of 18, in which case, a parent or legal guardian may register, pay the entry fee, obtain the clue sheet and claim the prize on behalf of the underage potential finder. From July 4, 2007 (the “beginning date”) the Washington County “Hunt for History” will run until the treasure is claimed, or until July 4, 2008 (the “End Date”), whichever is sooner. *Value as of January 1, 2007
2.ELIGIBILITY: Open to all registered and entered persons with a valid Official Clue Sheet except where prohibited by law. Finders may be required to execute an affidavit swearing to compliance with these eligibility requirements. Employees of “Colossus Enterprise LLC”, their immediate family and household members (related or not) and agents participating in the creation of this Washington County “Hunt for History”, are not eligible to enter.
3. DETAILS: Solutions to the clues in the clue sheet have been recorded and are maintained in a secure location. Solutions will be revealed through Washington County media outlets after the End Date or after the treasure is claimed, whichever is sooner. On behalf of Colossus Enterprise LLC, half of all entry fee proceeds will benefit the individual organizations that collected them. The remainder of these funds will be used to compensate Colossus Enterprise LLC for all costs associated with the production and execution of this and future events.
4. PARTICIPANT CONDUCT: Colossus Enterprise LLC reserves the right, in its sole discretion, to disqualify any Participant who (a) tampers with the entry process or the participation in, or operation of, the Washington County “Hunt for History”, (b) violates these rules; or (c) acts in a disruptive manner with the intent to annoy, abuse, threaten, or harass any other participant of person. Object Clues are located in public places on public property, and are not in dangerous locations such as underwater, on ledges, or in caves. Destruction or destroying real or personal property or the Object Clues themselves is not necessary in order to find the Object Clues or otherwise participate. Colossus Enterprise LLC expressly forbids any such conduct. By participating, you agree to be bound by these Official Rules and the decisions of Colossus Enterprise, LLC, which shall be final in all respects on all aspects pertaining to the Washington County “Hunt for History”. Colossus Enterprise, LLC shall have complete discretion to interpret these Official Rules and any other aspect of the Washington County “Hunt for History”, and expressly reserves the right to refuse to award the prize to anyone who in their discretion is in breach of these Official Rules or otherwise fails satisfactorily to establish their eligibility to win.
5. REDEMPTION INSTRUCTIONS: Upon solving the final clue, potential finders must mail the discovered location of the treasure, photocopies of their Object Clues, a copy of the front page of their map with its number showing, along with your name, age, address, and all other contact information to the correct address. Correct entry packets will then be contacted and asked to provide their solutions to the puzzles which led them to the locations where they found the Object Clues, and execute an affidavit of eligibility and liability/publicity release. If their solutions are verified as accurate, the potential finder has been registered and entered and have in their possession an Official Clue Sheet, and is determined to have used their intellect and skill in order to solve the Washington County “Hunt for History”, provided that the potential finder is in all other respects eligible to receive the prize, potential finder will be declared the “Finder”. Potential finders who submit possible solutions will be notified for further verification only if their solutions are correct, and eligibility requirements appear to be met. Potential finders should keep copies of all correspondence as well as copies of their solutions to the puzzles and how they arrived at them for their records. Additional verification requirements and redemption instructions may be required. Finders must return the affidavit of eligibility and liability/publicity release within 21 days of first attempted notification of verification, or be disqualified. For Finders who are younger than the age of 18, prize will be awarded in the Finder’s name to his/her parent or legal guardian, and affidavits and releases must be signed by the Finder’s parent or legal guardian. Finder must give Colossus Enterprise LLC permission to publicize finder’s name and hometown as a condition of receiving the prize. Finder may also be required to use their names and submissions in advertising and marketing materials in all media in perpetuity, and may be required to participate in publicity events. Upon verification of a registered potential finder’s eligibility, the finder’s solutions and methods will be reviewed. If correct and in accordance with these rules, an announcement will be made through local Washington County media that the treasure has indeed been claimed, and this Washington County “Hunt for History” will be officially declared ended. At such time, a date will be set for Finder to take possession of the prize, with a public ceremony to award a certificate of “Findership” to follow.
6. COLLABORATIONS: Collaborations with other persons in order to decipher the clues is allowed and encouraged. If you have collaborated in your efforts with other persons, each of the finding participants must also comply with all of the foregoing requirements, including having registered, entered and obtained an Official Clue Sheet, and execute all of the required documents. Collaborators must also release Colossus Enterprise LLC from any liability in connection with their agreement among one another, and if Colossus Enterprise LLC incurs any costs or expenses, including legal expenses, in connection with collaborators’ agreement, all collaborators agree to reimburse Colossus Enterprise LLC for any and all such costs and expenses jointly and severally.
7. PRIZE: $5,080* in gold or $2,500 in the form of a check from Colossus Enterprise LLC. IRS regulations require Colossus Enterprise LLC to issue a 1099 tax form to anyone receiving either prize in this event. *Value as of January 1, 2007
8. GENERAL: All submissions to Colossus Enterprise LLC become property of Colossus Enterprise LLC and will not be returned. Colossus Enterprise LLC accepts no liability for map or product shipments, submissions, correspondence or attempted redemptions that are late, lost, or otherwise misdirected, or not submitted in accordance with these Official Rules. If no verified eligible winner claims the prize, Colossus Enterprise LLC will publicly donate the prize to the participating Washington County organization that registered the most participants. No transfer or substitution of prizes is permitted by winners, except as indicated herein. Colossus Enterprise LLC has made extensive efforts and taken reasonable steps to ensure that the Object Clues remain where they are for location by participants in this event. Colossus Enterprise, LLC will also, at various times during the promotion period, attempt to confirm that the Object Clues remain in their respective locations. However, Object Clues may be moved by forces, including human intervention (intentional and unintentional) as well as force majeure events, over which Colossus Enterprise LLC has no control. Colossus Enterprise LLC disclaims all liability if, due to forces outside its control including but not limited to human intervention, an Object Clue is moved from its location or otherwise damaged or destroyed. In such instance, an announcement will be made through Washington County media and via the website, and steps will be taken to preserve the Washington County “Hunt for History”.
9. ADDITIONAL LIMITATIONS: By entering, participants and all persons associated with the participant, including but not limited to, family members, legal guardians, friends and employees: (a) agree to be bound by the official rules and the decisions of Colossus Enterprise LLC which are final and binding in all respects; (b) agree to release and indemnify Colossus Enterprise LLC along with their employees, families and agents or associated charitable organizations, agencies, groups or businesses from any and all liability, loss, damage or injury resulting from participation in this Washington County “Hunt for History” and searching for the Object Clues, as well as awarding, receipt, possession, use and/or misuse of any prize awarded herein and acknowledge that Colossus Enterprise LLC along with their employees, families and agents or associated organizations, agencies, groups or businesses have neither made or are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied in fact or in law, relative to any prize including, but not limited to, its quality, likeness, mechanical condition or fitness for a particular purpose; and (c) consent to use of his/her name, photograph and/or likeness for advertising and promotional purposes without additional compensation.
10. DISPUTES: This Washington County “Hunt for History” is governed by the laws of the United states, the State of Indiana, and Washington County, Indiana, without respect to conflict of law doctrines. As a condition of participating in the Washington County “Hunt for History”, all participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Washington County “Hunt for History”, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Washington County, Indiana having jurisdiction. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (e.g. costs associated with entering), and participant further waives all rights to have damages multiplied or increased.
11. PUBLICATION OF FINDER: After verification of potential finder’s eligibility and solutions as indicated above, the Finder will be named and contacted and will be announced on the official website and in local media outlets including but not limited to newspapers, websites, and radio announcements.
12. COLOSSUS ENTERPRISE, LLC: Colossus Enterprise LLC wishes to, through this event, help promote historical community awareness, raise funds to benefit the participating Washington County organizations and encourage knowledge of Washington County’s rich heritage.
